According to a report from DF SUD, the Chinese company Cosco Shipping, which has operations at the Chancay megaport in Peru, stated that, due to the fact that the service tariffs for this maritime terminal will be regulated, it is considering suing Peru.
Additionally, the company pointed out that since the start of its operations at the megaport in November 2024, it has always adhered to the terminal’s regulations, offering competitive conditions in the Peruvian market. However, Indecopi, the consumer protection agency, expressed the opposite, claiming that Cosco was not acting in such a manner.
Cosco also emphasized that the port offer at the megaport generates logistical efficiency and contributes to legal stability, benefiting both the investments made and the operation that favors the terminal’s users.
Furthermore, the company added that these conditions "determine the competition at the port as considered by the relevant state authority specialized in port matters, reserving the right to take the necessary legal actions within the framework of the current legal system."
On the other hand, the agency responsible for supervising transport in Peru announced it would regulate Chancay’s tariffs, following the conclusion of the market regulatory body, which determined that the terminal operates without competition in the country.
In particular, the consumer defense institute (Indecopi) stated that, after studying all of the megaport’s operations, it concluded that the ideal conditions for competition were not being provided at the maritime port. Additionally, Indecopi mentioned that the organization responsible for setting the new tariffs is Ositrán, which acts as the transportation regulator in the South American country.
Last but not least, it is worth mentioning that the Chancay megaport was financed by the government of the People's Republic of China, and the company Cosco Shipping Ports made an investment of 1.4 billion dollars for its construction. The project was inaugurated by the President of Peru, Dina Boluarte, and the President of China, Xi Jinping, during the Asia-Pacific Economic Cooperation (APEC) forum.
